Protecting Intellectual Property Rights
Trademark and Copyright Registration and Litigation
Federoff Kuchmay helps small businesses register their trademarks and copyrights and also defends those intellectual property rights in legal conflicts with competitors.
Based in Fort Wayne, we serve entrepreneurs and established companies throughout northeast Indiana. Attorney Scott Federoff offers 12 years of experience in business law, including extensive work in trademark and copyright law. Contact us today to discuss how we can help.
Establishing Trademarks and Copyright
We initiate federal trademark registration, Indiana trademark registration, or both. There are two types of applications:
- In Use — Formalizing trademarks which are already employed in commerce, to ward off infringement or establish foundation for litigation.
- Intent to Use — Applications to protect unique services or marks not yet established in the marketplace; registration is activated once the trademark or service mark is put in use.
Scott Federoff also handles federal copyright applications for all types of original works, from music and photography to computer software and architectural building plans. His services extend to contractual agreements for assignment and licensing of clients' trademarked or copyrighted property.
Trademark and Copyright Litigation
Our lawyers are experienced in intellectual property litigation and have successfully initiated and defended intellectual property infringement claims under the federal Lanham Act to refute infringement, stop infringement or sue for damages.
