Land Use, Real Estate and Business Law Appeals
Accomplished Appellate Lawyers in Fort Wayne, Indiana
Federoff Kuchmay LLP picks up where other attorneys fell short or fear to tread — we take civil litigation appeals to Indiana and federal appellate courts. Many law firms that practice real estate development and transactions do not handle land use and zoning litigation, and still fewer handle appeals of those decisions.
We not only practice in appellate law, but can boast important appellate decisions that clarified gray areas of the law and changed the legal landscape for Indiana developers and land owners.
Trial lawyers Jason Kuchmay, James Federoff and Scott Federoff have all contributed to our firm's landmark appeals. Our practice in appellate law mirrors our transaction and litigation practice:
- Zoning, land use, permitting and ordinances
- Commercial property transactions and construction
- Business transactions and contracts
- Lakeshore and residential property disputes
- Will contests and probate litigation
- Other corporate, commercial and real estate litigation
We have been successful in appeals of zoning and rezoning decisions by local governmental entities that erected significant barriers to development. The landmark ruling in City of New Haven v. Flying J Inc., in which we prevailed twice before the Indiana Court of Appeals, established a vested right of developers that cannot be eliminated by changing a zoning ordinance after projects have begun. In another notable zoning appeal, we helped define "substantial evidence" for the first time in zoning denials, ending unfounded objections that had until then allowed virtually any opponent to delay projects.
We handle appeals of cases that are referred by other attorneys, as well as appeals in the natural progression of our own litigation. We have prosecuted and defended cases before local trial courts, the Indiana Court of Appeals, and in federal appeals in the U.S. Circuit Court of Appeals.
