REPRESENTATIVE PROJECTS:

Following are a few examples of some of our recent development projects:

Belmont BeverageBelmont Beverages Headquarters – When its downtown store and headquarters were threatened with condemnation to make way for the Harrison Square development, Belmont Beverage Stores of Indiana enlisted us to assist with the legal work necessary to relocate its headquarters and main warehouse to a new location. We negotiated the buy-out of an existing lease that allowed the client to acquire an adjacent property, negotiated access easements with abutting landowners, and obtained the land use approvals and permits needed to allow the combination of two buildings and lots into one property and the renovation of the storefront and parking lot to accommodate the relocation.

Cedar SpringsCedar Springs Subdivision - We routinely work with developers of residential subdivisions. One example was Cedar Springs Subdivision, which is being developed by Max Shambaugh's company M-B-C Corp. Our attorneys worked closely with the project engineer to obtain the governmental approvals necessary to plat the subdivision, including negotiation of various utility easements and development and maintenance agreements. We also drafted the covenants that govern use and development of the subdivision, and created the subdivision's owners association.

Hanson Ardmore QuarryHanson Ardmore Quarry – Our attorneys assisted Hanson Aggregates Midwest, Inc. in expanding its limestone quarries in northern Indiana. Our involvement included negotiating the assemblage of the real estate needed for the expansion, coordinating the vacation and closing of a public road, rezoning the additional property, and obtaining the necessary land use approvals and permits.


  

Illinois Professional ParkIllinois Professional Park – Steven J. Hoagburg, DDS and James P. Klinger, DDS enlisted our services to locate and develop a professional office park for their practices. The firm assisted in locating and acquiring the parcel, rezoning the property, obtaining all necessary land use approvals and permits, negotiating with the Indiana Department of Transportation, negotiating cross-access agreements with adjoining properties, and creating the office park owners association.

 

Maysville PointeMaysville Pointe Shopping Center – The firm assisted in all facets of the development of this shopping center located in northeast Fort Wayne. We assisted with the negotiation of purchase agreements, land acquisition, rezoning the real estate, obtaining of other land use approvals, and creation of the commercial owners association.




Scott RoadThe Shoppes and Offices at Scott Road – This development for The Rogers Company was particularly important to the firm, as we were the first purchaser of a unit in the office condominium section of this project. We drafted both the retail commercial and office condominium declarations, and the condominium association documents for the office development. In January of 2004, we proudly took ownership of the first condominium unit in this project.


Republic ServicesRepublic Services Landfill Expansion – Our lawyers have been called on to assist in handing zoning proceedings for creation and expansion of landfills in the northeast Indiana. We worked closely with environmental engineers, hydrogeologists, and other scientific consultants to complete the land use approval and permitting process.




Savannah SpringsKeller Development, Inc. Tax Credit Projects – We work regularly with this local, third-generation company in development of low income housing tax credit, multi-family projects throughout Indiana. We assist in site selection and acquisition, obtaining rezoning and other necessary land use approvals, and tax abatement proceedings.




STAR Financial BankSTAR Financial Bank Branch – When STAR Financial Bank encountered problems in attempting to obtain the necessary approvals to construct a bank branch that included a Starbucks, bank officials called in our lawyers to help overcome the hurdles and complete the project . We were able to successfully rezone the site to a higher commercial classification necessary to accommodate the more intense commercial use, and to obtain the necessary land use approvals to allow this unique concept to move forward.


Vreba-HoffVreba-Hoff Dairy CAFOs – We have represented this multi-national agribusiness in land use and zoning proceedings, as well as related litigation, for large dairy confined feeding operations in all regions of Indiana. Although this land use, like mining operations, landfills, and similar businesses, generate substantial opposition from nearby property owners, the experience and reputation of our lawyers resulted in a number of successful administrative and court decisions for the client.
